Both federal and state laws prohibit government actors – municipal officials, for example, or police officers – from interfering with the exercise of the First Amendment right to free speech, or other constitutional rights. Public employees can also bring claims that their government employers deprived them of constitutional protections.

Our state has a particularly strong civil rights law, set forth in the New Jersey Civil Rights Act, N.J.S.A. 10:6-1 et seq. The NJCRA provides a remedy for any person who has been deprived of any substantive due process or equal protection rights, privileges or immunities secured by the federal or state Constitutions.
